By accessing or using any Sasquatch Property Management services, including our owner portal, tenant portal, or any digital platforms, you agree to these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using our services.

1.2 Eligibility

To use our services, you must:

  • Be at least 18 years of age
  • Have the legal capacity to enter into binding contracts
  • Provide accurate, current, and complete information during registration
  • Maintain the security of your account credentials
  • Promptly notify us of any unauthorized use of your account

1.3 Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes via email or through our portals. Your continued use of our services after such modifications constitutes your acceptance of the updated Terms.

Sasquatch Property Management provides comprehensive property management services including but not limited to:

  • Property marketing and tenant placement

  • Rent collection and financial management
  • Property maintenance coordination
  • Lease administration and renewals
  • Property inspections and reporting
  • Eviction proceedings when necessary
  • 24/7 emergency maintenance coordination

2.2 Digital Platform Services

We provide secure online portals offering:

  • Online rent payment processing
  • Digital document management and storage
  • Maintenance request submission and tracking
  • Financial reporting and tax documentation
  • Electronic lease signing and management
  • Real-time property performance metrics

⚡ Service Availability

While we strive for 99.9% uptime, we cannot guarantee uninterrupted access to our digital services. Scheduled maintenance and updates may temporarily affect availability.

3. Portal Use and Account Security

3.1 Account Creation

To access our online portals, you must create an account by providing:

  • Valid email address and phone number
  • Legal name and identification
  • Property or tenancy information as applicable
  • Banking information for transactions (encrypted and secure)

3.2 Account Security

You are responsible for:

  • Maintaining the confidentiality of your login credentials
  • All activities that occur under your account
  • Immediately notifying us of any security breach
  • Ensuring your account information remains current and accurate

3.3 Prohibited Uses

You agree not to:

  • Transmit viruses, malware, or any destructive code
  • Impersonate another person or entity

⚠️ Security Warning

Never share your login credentials with anyone. Sasquatch Property Management will never ask for your password via email, phone, or any other communication method.

4. Payments and Financial Terms

4.1 Management Fees

Property owners agree to pay management fees as outlined in their individual Property Management Agreement. Fees may include:

  • Monthly management percentage or flat fee
  • Tenant placement fees
  • Lease renewal fees
  • Maintenance coordination fees (if applicable)
  • Other agreed-upon service charges

4.2 Tenant Payments

Tenants using our online payment system agree to:

  • Pay rent by the due date specified in their lease agreement
  • Pay any applicable processing fees for certain payment methods
  • Maintain sufficient funds for automatic payments if enrolled
  • Be responsible for any fees resulting from failed payments

4.3 Payment Processing

All online payments are processed through secure, PCI-compliant payment processors. We do not store credit card or banking information on our servers. By making a payment, you authorize us to charge the payment method provided for the amount specified.

4.4 Refund Policy

Refunds are handled on a case-by-case basis in accordance with applicable laws and individual agreements. Management fees are generally non-refundable once services have been rendered.

5. Privacy and Data Protection

5.1 Data Collection and Use

We collect and process personal information in accordance with our Privacy Policy, which is incorporated into these Terms by reference. By using our services, you consent to our data practices as described in the Privacy Policy.

  • Remove any copyright or proprietary notations

By submitting content to our platforms (such as maintenance requests, documents, or communications), you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and display such content as necessary to provide our services.

7. Disclaimers and Limitations of Liability

7.1 Service Disclaimer

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

7.2 Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, SASQUATCH PROPERTY MANAGEMENT LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

7.3 Indemnification

You agree to indemnify, defend, and hold harmless Sasquatch Property Management LLC, its officers, directors, employees, agents, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorney's fees) arising from your use of our services or violation of these Terms.

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so some of the above limitations may not apply to you.

8. Dispute Resolution

8.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of law provisions.

8.2 Arbitration Agreement

Any dispute arising out of or relating to these Terms or our services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Pierce County, Washington.

8.3 Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

8.4 Time Limitation

Any cause of action or claim you may have arising out of or relating to these Terms or our services must be commenced within one (1) year after the cause of action accrues; otherwise, such cause of action or claim is permanently barred.

9. Termination

9.1 Termination by You

You may terminate your account at any time by:

  • Providing written notice to our support team
  • Settling all outstanding balances
  • Following the termination procedures in your specific agreement

9.2 Termination by Us

We may suspend or terminate your access to our services immediately if:

  • You violate these Terms or any applicable agreement
  • You engage in fraudulent or illegal activities
  • You fail to pay fees or charges when due
  • Your actions harm or threaten to harm others or our services
  • Required by law or legal process

9.3 Effect of Termination

Upon termination:

  • Your right to access our services will immediately cease
  • All outstanding fees become immediately due and payable
  • We may delete your account data after a reasonable retention period
  • Provisions that by their nature should survive termination will remain in effect

10. General Provisions

10.1 Entire Agreement

These Terms, together with our Privacy Policy and any specific agreements you have with us, constitute the entire agreement between you and Sasquatch Property Management LLC regarding our services.

10.2 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.

10.3 Assignment

You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign our rights and obligations under these Terms without restriction.

10.4 No Waiver

Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

10.5 Force Majeure

We shall not be liable for any failure or delay in performance under these Terms which is due to fire, flood, earthquake, pandemic, governmental action, war, terrorism, or other unforeseeable cause that is beyond our reasonable control.

10.6 Notices

All notices under these Terms shall be in writing and deemed given when delivered personally, sent by confirmed email, or sent by certified or registered mail, return receipt requested, to the addresses provided in your account or agreement.
